On 22 June 2021 the Corporate Insolvency and Governance Act 2020 (Coronavirus) (Extension of the Relevant Period) (No. 2) Regulations 2021 (SI2021/718) were published and came into force yesterday.

The Regulations:

  • Extended the period of suspension of service of a statutory demand on a company from 30 June 2021 to 30 September 2021;
  • Extended the period of suspension of issuing a winding-up petition for non-payment of a debt due to Covid-19 from 30 June 2021 to 30 September 2021;
  • Extended the relaxation in the conditions for a company to enter a Part A1 moratorium until 30 September 2021.

Notably, the Regulations did not extend the suspension of the wrongful trading rules nor the exemption for small suppliers from the restrictions on terminating supply contracts as a result of the customer's insolvency. Both suspensions expired on 30 June 2021.
